Costs Budgeting
What is Costs Budgeting? It’s a process of estimating and controlling the expenses that are incurred in the course of a legal matter. It involves forecasting the amount of time and resources that will be required to resolve a legal action and determining the financial implications of each stage of the litigation process. The purpose of legal costs budgeting is to provide transparency and predictability in the management of legal expenses and to help Solicitors manage the costs associated with their legal matters.
The process of preparing a Costs Budget involves preparing an estimate for each stage of the case (known as phases), based on an analysis of the likely work involved and incurred by lawyers and other professionals, given foreseeable events. The budget will typically include an estimate of the time that will be required for each stage, and the associated costs, such as legal fees, expert witness fees, and the cost of obtaining documents or other evidence. The costs budget should be regularly reviewed and updated as the case progresses and any significant changes in the circumstances of the case will be considered. Where it is likely that the confines of the budget will be exceeded in any given phase, an application should be made by the conducting Solicitor to extend/amend the budget to take account of the change of circumstances that have led to the increase in work that was not anticipated.
Costs budgeting is an important tool for Solicitors, whether Defendant or Claimant centred, and assists them to manage their legal cost spend over the course of the action so that once the case is concluded, the level of costs presented in the Bill of Costs can be easily agreed by the paying party.
Costs Negotiations
Negotiating on Bills of Costs is a fine art. Something that takes planning and full consideration of the factors at play in the case as well as considering the likely challenges that will be raised by the paying party. We have been sparring with Defendant costs personnel for over 20 years and have extensive experience in the process and tactics of the paying party.
We appreciate that an element of give and take is needed, and that being brash and abrasive doesn’t get you as far as being cordial and professional does. We don’t enter negotiations half-cocked and always know what our bottom line is and what an ideal settlement looks like. It’s the part of the costs process that we love and as a result we excel at it.
We won’t palm your costs off to junior or fresh-faced staff. It’s all done by the man at the top. We take it seriously and don’t waiver from our goal. Your costs are as important to us as they are to you and your firm.
Our Rates
Our drafting rates are usually billed on an hourly basis, in the same way as solicitors bill their time.
Our drafting hourly rate varies depending on the type and complexity as well as the nature of Bill of Costs that is needed. The rate varies from £160.00 per hour to £200.00 per hour.
We can work based on a percentage in the same way many other draftsmen do. The range of percentage fee that can be agreed is between 4.5% and 6.0%.
While we can work on a percentage fee basis, we prefer to work on an hourly rate as this is the most transparent way of doing business together.
