Jarvis Costs Consultancy offers a prompt and accurate assessment of your file of papers followed by the preparation of a schedule of costs, within 48 hours of receipt. All drafting work is double checked for accuracy before being sent to the Solicitor for approval. We include a charge for our time spent in preparing each schedule so that our fees can be recovered in part or in full from the paying party.
Jarvis Costs Consultancy will consider your full file of papers and present a draft Bill of Costs for approval by the Solicitor within 1 week from the date of receipt (for bills of £7,500.00 profit costs or less) but this time scale is often surpassed with your draft bill arriving within a matter of days. Accuracy and attention to detail are of utmost importance to Jarvis Costs Consultancy and each draft Bill of Costs is double-checked before being sent to the Solicitor client. We also include our own fees, as rightfully recoverable, in each Bill of Costs so that the receiving party is not responsible for paying the full extent of drafting charges.
When pursuing any claim for costs to Detailed Assessment the paying party will be required to serve on the receiving party a set of formal arguments, known as Points of Dispute. Contained within the Points of Dispute will be details of the items which are being challenged by point of law. Points of Dispute can vary considerably in length from file to file, but it is in the interests of expediting a settlement for the Points of Dispute to be specific about what each challenge is and in each instance should suggest a figure for compromise of the item. When Points of Dispute are received Jarvis Costs Consultancy staff will thoroughly consider the validity of the arguments raised and prepare a formal set of Replies to the Points of Dispute. The object of the Replies is to assist in eliminating items on the Bill of Costs which can be agreed and to highlight those items on which the receiving party is not prepared to accept a reduction or compromise. By discussing the merits of both sides case the parties are often better able to see where the strengths and weaknesses of their case lie. In some instances this will lead to a further round of negotiations and in others it will serve to narrow those issues which are to be discussed at the full Detailed Assessment hearing. With the attention to detail that existing clients of Jarvis Costs Consultancy have come to expect you can be sure that a prompt assessment of disputes will be made and advice as to the best course of action for concluding the claim will be provided.
Our experienced personnel deal with costs negotiations at all stages of our instruction. A realistic and pragmatic approach is always taken when negotiating. Our excellent working knowledge of costs issues means that we are always prepared to rebut arguments raised by the other side which challenge costs payable. Each file of papers is considered on its own merits and evaluated from a costs perspective so that it can be progressed without delay. Because we include our own fees in both Schedules and Bills of Costs we are often able to recover a percentage of our charges from the paying party. This lessons the impact of our own fees on our client when the matter is concluded.
When negotiations have reached an impasse a Detailed Assessment hearing may be required. Jarvis Costs Consultancy will fully prepare all documents and bundles necessary for a Detailed Assessment in accordance with prescribed rules. We will consider relevant case law, review costs offers from both sides to ensure that our clients' position is protected. We will prepare a full advice accordingly to the instructing Solicitor following our review. On the basis of the advice given and when it is agreed that a Detailed Assessment is required, Jarvis Costs Consultancy staff will attend at court to argue on behalf of the instructing Solicitor. Once the Detailed Assessment is complete Jarvis Costs Consultancy will prepare a full breakdown of the resulting costs awarded and the terms of the order made setting out in detail the nature and success of arguments and counter-arguments made on the day.
Jarvis Costs Consultancy will consider any individual file, whether costs negotiations have commenced or not. We will then provide a letter of advice and tactics for continued negotiations and a profitable settlement. Alternatively, Jarvis Costs Consultancy will take over conduct of any pre-existing negotiations and pursue the same to conclusion.
